Economic Freedom Fighters (EFF) leader Julius Malema did not serve jail time following his 2022 conviction for discharging a firearm in public. The incident dated back to 2018 at the EFF's fifth-anniversary rally at the Sisa Dukashe Stadium in the Eastern Cape.
In March 2022, the East London Magistrates' Court found Malema guilty of contravening the Firearms Control Act. He was sentenced to a fine of R6,000 or 18 months' imprisonment, with an additional 18-month prison sentence suspended for five years. This suspended sentence meant he would not be incarcerated unless he committed a similar offense within that period.
Malema and his co-accused, bodyguard Adriaan Snyman, immediately filed for leave to appeal both the conviction and sentence. The court granted this leave, automatically suspending the sentence pending the appeal's outcome. As of April 2026, the appeal process is ongoing, meaning the original sentence has not been enforced.
